Norton apresentou uma abordagem que se tornou influente para explicar como os experimentos mentais científicos podem produzir novos conhecimentos so- bre o mundo. Ele afirma que não há nada distintivo nos experimentos men- tais, uma vez que sustenta que eles funcionam exatamente como argumen- tos. Neste artigo, contestamos sua abordagem. Examinamos aspectos essen- ciais de sua abordagem, que envolvem as noções de (...) “argumento” e “inferên- cia” para mostrar que um sujeito que chega a saber algo através da execução ou condução de um experimento mental dificilmente será considerado como tendo efetivamente executado um argumento ou um processo de raciocínio inferencial. En este artículo se presenta el guión de una conferencia que Roberto Lehmann-Nitsche, pocos años después de radicarse en la Argentina, desarrolló en 1901 acerca del folklore mapuche. La intervención se realizó a solicitud de la Deutschen Frauen Verein, una asociación de mujeres alemanas con sede en la ciudad de Buenos Aires, y abordó aspectos teóricos sobre esta disciplina, entonces en expansión, desde la perspectiva germana. Además, realizó una catalogación de los materiales empíricos documentados por este antropólogo durante (...) los primeros años de su residencia en el país. El texto original, hasta el momento inédito, se entrega en su versión en alemán y en traducción al español. En la presentación se proporciona un análisis que permite reconocer cómo en esta intervención se integran apreciaciones que Lehmann-Nitsche también sostuvo en posteriores publicaciones científicas y de divulgación por él realizadas. Como se sabe, su producción en el campo del folklore comprendió dos vertientes: por un lado, el folklore criollo y por otro, el devenido de arte verbal y tradiciones de los pueblos indígenas preexistentes, en especial textos correspondientes a géneros narrativos y adivinanzas en las lenguas propias y en castellano. En relación con este último aspecto, se retoman aportes de autores filiados en la tradición germana a fin de indicar afinidades y vínculos, con algunos americanistas que eran sus contemporáneos. Among the extensive literature on the first Critique, very few commentators offer a thorough analysis of Kant's conception of inner sense. This is quite surprising since the notion is central to Kant's theoretical philosophy, and it is very difficult to provide a consistent interpretation of this notion. In this paper, I first summarize Kant's claims about inner sense in the Transcendental Aesthetic and show why existing interpretations have been unable to dissolve the tensions arising from the conjunction of these claims. (...) Secondly, I present my own reconstruction of Kant's model of inner sense, relying essentially on Kantian considerations found in the B-version of the Transcendental Deduction. My main idea is that inner sense, for Kant, is a passive faculty that gets affected by the understanding performing its figurative synthesis on material given in outer sense. In the remainder of the paper, I highlight a few consequences of my interpretation and outline ways to deal with some objections. (shrink)

Male-to-female transsexualism manifests itself in the form of a discrepancy between the male sex assigned at birth and the subjective experience of belonging to the female gender, which in many cases also involves a somatic transition by cross-sex hormone treatment and genital surgery. Until now, no studies related to MtF transsexualism have been carried out within the framework of a phenomenological/existential approach. This paradigm would make it possible to better articulate the transsexual experience beyond the simplistic diagnostic criteria by which (...) it is currently defined. In this study, I will reread MtF transsexualism in the light of Ludwig Binswanger’s theories on Mannerism and Jean Paul Sartre’s remarks on the self and the body. I will do this largely by focusing on first-hand accounts of the MtF transsexual’s experience, in other words from a first-person viewpoint. Finally, I will present some considerations on the meaning of psychological intervention in this field. (shrink)

Responding to Hasok Chang’s vision of the history and philosophy of science as the continuation of science by other means, I illustrate the methods of HPS and their utility through a historico-critical examination of the problem of “time’s arrow‘, that is to say, the problem posed by the claim by Boltzmann and others that the temporal asymmetry of many physical processes and indeed the very possibility of identifying each of the two directions we distinguish in time must have a ground (...) in the laws of nature. I claim that this problem has proved intractable chiefly because the standard mathematical representation of time employed in the formulation of the laws of nature “forgets‘ one of the connotations of the word ”time’ as it is used in ordinary language and in experimental physics. Over the last decade, several European countries and the Council of Europe itself have strongly supported the use of advance directives as a means of protecting patients’ autonomy, and adopted specific norms to regulate this matter. However, it remains unclear under which conditions those regulations should apply to people who are placed in correctional settings. The issue is becoming more significant due to the increasing numbers of inmates of old age or at risk of suffering from mental disorders, all of (...) whom might benefit from using advance directives. At the same time, the closed nature of prisons and the disparate power relationships that characterise them mean that great caution must be exercised to prevent care being withdrawn or withheld from inmates who actually want to receive it. This paper explores the issue of prisoners’ advance directives in the European context, starting with the position enshrined in international and European law that prisoners retain all their human rights, except the right to liberty, and are therefore entitled to self-determination regarding health care decisions. El artículo analiza el vínculo entre derecho y violencia en Walter Benjamin y Franz Rosenzweig. Primero, se estudia la relación entre Benjamin, Rosenzweig y Carl Schmitt, y, a continuación, la proximidad entre las concepciones benjaminiana y rosenzweiguiana de la historia y de la temporalidad mesiánica, así como la relación entre justicia, derecho y eternidad. Finalmente, se presenta la propuesta derridiana de una deconstrucción de la crítica benjaminiana de la violencia y su antecedente en _La estrella de la redención_.

Riassunto : Il presente articolo intende lumeggiare l’esito tanto fecondo quanto problematico a cui conduce l’originale opera laskiana di risemantizzazione del concetto di soggettività. Al centro di tale opera si staglia la progressiva elaborazione di ciò che il filosofo rubrica, al termine del suo Denkweg, sotto il titolo di soggetto ricettivo. Con tale concetto, a cui è intimamente legato quello di “dedizione”, Lask individua in una mera ricettività intuitiva il momento sorgivo e originario di ogni processo cognitivo; il solo momento (...) che rende possibile un accesso diretto all’oggetto trascendente. Ma come si realizza questo accesso? Qual è lo statuto di ciò che il filosofo nomina “dedizione”? L’insufficiente risposta a tali quesiti conduce il pensiero laskiano ad un esito aporetico, ossia alla riduzione della dedizione a momento ideale e alla conseguente riattivazione, in ambito conoscitivo, dell’inaggirabile distanza tra soggetto e oggetto. Ma, se in tale aporia è riconosciuto il limite del modello della conoscenza elaborato da Lask nel suo sistema maturo, non è comunque possibile occultare il decisivo contributo offerto dalla sua riflessione al problema gnoseologico: il superamento del coscienzialismo attraverso l’elaborazione di un soggetto concreto-ricettivo e, accanto a esso, di un peculiare realismo. Subjectivity and Receptiveness: This paper intends to illuminate the problematic outcome of Lask’s redefinition of the concept of subjectivity. The main result of this operation is the elaboration of the notion of receptive subject. With this concept, strictly linked to the notion of Hingabe, Lask identifies the original element of every cognitive process in simple intuitive receptivity. Intuitive receptivity alone provides direct access to the transcendent object. But how is this access possible? What is the relation between the receptive-intuitive element of knowledge and predicative activity? What is the status of Hingabe? The insufficient answers to these questions lead the Lask’s thought to an aporetic outcome, namely, the reduction of Hingabe to an exclusively abstract and ideal receptivity, and consequently to the reactivation, in the theory of knowledge, of the distance between subject and object. However, while this distance marks the limit of the model of knowledge developed by Lask, the main contribuition of his thought remains valid: the overcoming of trascendental subjectivism through the elaboration of a concrete-receptive subject and of an original form of realism. Evolution has become the standard way of understanding the world process. Theology has to express traditional faith in the context of the contemporary world. Since the common world view has profoundly changed, from a static world of being into a dynamic world of becoming, theology needs to change its language and its understanding of the universe as God's creation. This understanding of an evolving world is to be used as a theological source. Such a change of perspective necessitates a fundamental (...) reconstructing of theology; for theology, such reconstructing means a renewed understanding of the Creator and of the Incarnation. The age–old dilemma of free will and determinism is attacked by proving that both sides are flawed with contingencies, that the notion of eternal law is a theologically tainted projection rather than a reality of the real world that is understood to be evolutionary. Determinism is dissolved into conditionalism. This excludes materialistic scientific explanation of the deterministic style. As it brings forth freedom, evolutionary reality transcends essentially the explanatory possibilities of statistically structured natural laws. The dilemma of determinism and free (...) will based on a logic of contradiction is replaced by an ontology of polarity. (shrink)

Legal discourse is, admittedly, a rational message. As such, it presupposes some kind of logical structure. Nevertheless, legal theorist are not agreement as concerns the adequate logic law requires. A proposal to develop a specific logic, called “idiomatic legal logic”, is discussed as regards its consequences for an understanding of the rationality of law. Further, linguistic models adopted for the explanation of legal concepts are also considered, inasmuch as they imply that law is somehow isomorphic with Iinguistic structures.

In this work, I have used many sources because this theme is very complex and it is very useful to follow tracks already well used by other authors who have ventured with these themes. The Gender report is a report on equality. No company will ever be expected to be right if it does not foresee includesive actions rather than excludents. The social constructions of the same company will have to contend with a reality of reference that embraces all the (...) universes and respects the personal values. In this paper I take a sceptical view of the standard cosmological model and its variants, mainly on the following grounds: (i) The method of mathematical modelling that characterises modern natural philosophy-as opposed to Aristotle's-goes well with the analytic, piecemeal approach to physical phenomena adopted by Galileo, Newton and their followers, but it is hardly suited for application to the whole world. (ii) Einstein's first cosmological model (1917) was not prompted by the intimations of experience but by a desire to (...) satisfy Mach's Principle. (iii) The standard cosmological model-a Friedmann-Lematre-Robertson-Walker spacetime expanding with or without end from an initial singularity-is supported by the phenomena of redshifted light from distant sources and very nearly isotropic thermal background radiation provided that two mutually inconsistent physical theories are jointly brought to bear on these phenomena, viz the quantum theory of elementary particles and Einstein's theory of gravity. (iv) While the former is certainly corroborated by high-energy experiments conducted under conditions allegedly similar to those prevailing in the early world, precise tests of the latter involve applications of the Schwarzschild solution or the PPN formalism for which there is no room in a Friedmann-Lematre-Robertson-Walker spacetime. ZusammenfassungDie in den vergangenen Monaten auf den Weg gebrachten Initiativen zur Änderung des Schwangerschaftskonfliktgesetzes in Deutschland betonen den grundsätzlichen Stellenwert der Schwangerenberatung vor und nach Pränataldiagnostik und damit auch die Bedeutung der Entscheidung der Schwangeren. Vorstellbar und zum Teil auch bereits eingerichtet sind darüber hinaus Beratungsstrukturen für die in einen Abbruch involvierten Ärzte. Die vorliegende Arbeit untersucht die Möglichkeiten und Grenzen von Beratung für die Schwangere wie auch für die beteiligten Ärzte bei (späten) Schwangerschaftsabbrüchen. Die umfassende Beratung der Schwangeren kann (...) sowohl der Sicherung selbstbestimmter Entscheidungen als auch dem Schutz des ungeborenen Lebens dienen. Die hypothetisch-stellvertretenden Entscheidungen der zur Arztberatung eingerichteten Kommissionen aber lassen nicht nur Zweifel an ihrer Legitimation, sondern ebenso an dem grundsätzlichen Umgang mit der medizinischen Indikation aufkommen. Gesetzesinitiativen in diesem Bereich müssen sich deshalb auch mit der medizinischen Indikation befassen, wenn eine umfassende und konsequente Regelung angestrebt wird. (shrink)

I re-examine the starting point of the Philebus’ description of the ‘divine method’ and argue that the vexed phrase τῶν ἀεὶ λεγομένων εἶναι at 16c9 refers to sensibles only. In doing so, I especially stress the significance of the phrase τούτων οὕτω διακεκοσμημένων at 16d1. The proposed interpretation fits the rest of the description of the ‘divine method’, preserves the Forms’ unmixed nature and the consistency of the Philebus.

Most discussions of Rawls’s philosophy tend to neglect the strong communitarian strand of his theory: so much so that in the debate between liberals and communitarians Rawls’s account of community has been for the most part intriguingly absent. This article is an attempt to fill in the gap by offering a discussion of the Rawlsian understanding of community as it was presented in A Theory of Justice and its possible implications for a pluralist society. At the same time, I want (...) to take issue with one of the most influential critiques leveled against Rawls’s conception of the self: namely, Sandel’s critique of the ‘individuated subject’ that, in his view, underlies justice as fairness. Rawls’s constructions, so Sandel argues, rest on an unencumbered self that is individuated in advance and whose identity is fixed once and for all. (shrink)

The impossibility of predicting the future allows us only to indicate which theological developments seem to be needed. These developments concern our changing perception of the world, which requires a reversal in our understanding of God's Creation, from its most imperfect beginnings to its unforeseeable future. The passing of evolution from the biological to the human level has opened moral dimensions that must be explored. Rather than return to the beginnings of the church, theology needs to try to understand Christian (...) faith within evolution, to reinterpret the past in the light of the new. In evolution, no final doctrine is possible. The necessity for doctrine creates a constant tension with the necessity of its revision. New truth must be paid for by suffering. The need is for a coherent theological vision of Creation, Redemption, and God's action in the world. Teilhard's metaphysics of union may be the key to it. In this view love becomes the central force of creation, which in Teilhard's view opens into an eternal future in God: in its final stage, evolution becomes Christogenesis. (shrink)
